Background:
The Department of Ecology (DOE) has standards for conducting ship refueling and bunkering
operations, lightering of petroleum products, and transferring oil between an onshore or offshore
facility to a tank vessel. Standards include having containment and recovery equipment readily
available for the possible discharge of oil into Washington waters. Every person providing
bunkering, refueling, or lightering services has the responsibility to provide any containment or
recovery equipment. Each facility's contingency plan must also include the procedures used to
contain and recover discharges.
Summary of Bill:
The DOE standards will include performance-based methods to conduct refueling, bunkering,
lightering operations, and oil transfers while protecting the water. The standards will also
include provisions that consider the historical risks associated with individual facilities or groups
of facilities.
The DOE will adopt additional rules as necessary.

Effective Date: The bill takes effect 90 days after adjournment of session in which bill is passed.
