Background:
Substitute Senate Bill 5533, which was passed in the 2007 session, repealed RCW 10.77.090,
relating to competency restoration and civil commitment following dismissal of a criminal
case, and replaced it with three new code sections. Several other statutes still reference RCW
10.77.090, which is no longer in effect. Substitute Senate Bill 5533 also changed the
eligibility criteria for competency restoration treatment in non-felony cases. As a result,
certain definitions and other sections in Chapter 10.77 RCW are obsolete.
Summary of Bill:
This legislation corrects references to sections of Chapter 10.77 RCW which have been
repealed and removes obsolete definitions and references.
The amended bill as passed by the House leaves intact the definitions of the terms "history of
one or more violent acts" and "violent act" and leaves intact RCW 10.77.260 and 2000 c 74 s
5.

Effective Date: The bill contains an emergency clause and takes effect immediately.
