Background: When a child care center receives or renews its license through the Department of Early Learning (DEL), or is inspected by the DEL, it must provide to the DEL proof that it carries day-care insurance or is self-insured.

Family day-care providers may opt out of the requirement to carry day-care insurance but must provide written notice of their insurance status to parents whose children are enrolled in family day-care.

Summary of Bill: The law that grants the DEL authority to take enforcement action with respect to family day-care providers is amended to state that enforcement action may be taken when a family day-care provider fails to comply with the requirements of the law on day-care insurance. A reference to family day-care providers needing to notify the DEL upon termination of insurance coverage is eliminated.

EFFECT OF CHANGES MADE BY RECOMMENDED SUBSTITUTE AS PASSED COMMITTEE (Human Services & Corrections): The written notice of insurance status provided by family day-care providers to parents is required to be on a standard form developed by the Department of Early Learning and copies of the notice to each parent must be kept on file by the family day-care providers.

Staff Summary of Public Testimony: PRO: This bill does not impose any new requirements on licensed day-care providers. It simply gives the DEL the authority to enforce existing requirements. Requiring home providers to carry liability insurance and keep copies of parental notification should also be considered.
