Background: The state animal cruelty law contains provisions to determine whether a particular act constitutes a violation of animal cruelty laws.

Summary of Bill: Licensed egg producers must provide enough living space for caged egg laying hens so that each hen has sufficient space to fully extend both wings without touching the sides of the living space or other birds. An egg laying hen include female chicken, turkey, duck, goose, or guinea used for egg production.

Producers that do not provide this amount of space are guilty of restrictive confinement of a caged egg laying hen which is a gross misdemeanor and punishable by up to one year in jail and a fine of up to $5,000.

This act takes effect on January 1, 2009.
