    On page 3, beginning on line 17, strike all of lines 17 and 18 and insert "that are located:

(A) In a county with a population of over one million five hundred thousand; and

    (B) Within five miles of a nursing home licensed under chapter 18.51 RCW."

EFFECT:   Eliminates the certificate of need exemption for up to 25 swing beds for hospitals that have no nursing home within the same town or city limits.  Instead, provides a certificate of need exemption for up to 25 swing beds for a critical access hospital that is located (a)in a county with a population of over 1,500,000 (currently King County is the only county with a population of over 1,500,000) and (b) within five miles of a nursing home.
