"(5)(a) The partnership may not distribute any grant money under
this section unless the council makes a finding, based on peer-reviewed
scientific information, that saltwater algal blooms, unnatural sea
lettuce accumulation, and other algal problems proposed to be addressed
by this section are not caused by storm water runoff, discharge from
waste water treatment facilities, or other pollution sources within the
authority of a local government to minimize or control.
(b) If at the end of any fiscal year the council has not made this
finding, then all money in the saltwater algae control account must be
transferred into the freshwater aquatic algae control account created
in RCW 43.21A.667."
EFFECT: Transfers management of the saltwater algae control account from the department of ecology to the Puget Sound partnership and requires all money in the saltwater algae control account to be transferred to the freshwater aquatic algae control account if the leadership council of the Puget Sound partnership does not make a finding that saltwater algae issues are not caused by factors within the authority of local governments to control.
