    On page 5, after line 27, insert the following:

    "(7) Enforcement of this section by law enforcement officers may be accomplished only after a determination by the law enforcement officer that the driver of a motor vehicle is not violating RCW 46.61.525."

    On page 6, after line 26, insert the following:

    "(4) Enforcement of this section by law enforcement officers may be accomplished only after a determination by the law enforcement officer that the driver of a motor vehicle is not violating RCW 46.61.525."

EFFECT: Requires law enforcement officers, prior to enforcing the current prohibitions on holding a wireless communication device to his or her ear or sending, reading, or writing a text message while operating a motor vehicle, to determine that the driver of a motor vehicle is not engaged in negligent driving in the second degree.
