    On page 6, after line 26, insert the following:

    "(4) Enforcement of this section by law enforcement officers may be accomplished only after a determination by the law enforcement officer that the driver of a motor vehicle is texting and not watching a movie or other video."

EFFECT: Requires law enforcement officers, prior to enforcing the current prohibition on sending, reading, or writing a text message while operating a motor vehicle, to determine that the driver of a motor vehicle is indeed texting and not watching a movie or other video.
