     On page 5, after line 21 of the amendment, insert the following:
     "(31)(a) "Television" means an analog or digital device designed primarily for the display and reception of a terrestrial, satellite, cable, internet protocol television, or other broadcast or recorded transmission of analog or digital video and audio signals.
     (b) "Television" encompasses any units marketed to consumers as televisions, including:
     (i) Combination televisions, meaning systems in which a television or television monitor and an additional device or devices, including but not limited to a digital versatile device (DVD) player or a video cassette recorder (VCR), are combined into a single unit in which the additional devices are included in the television casing;
     (ii) Component televisions, meaning televisions composed of two or more separate components (e.g., separate display device and tuner) marketed and sold as televisions under one model or system designation, and which may have more than one power cord; and
     (iii) Television monitors, meaning televisions that do not have an internal tuner/receiver or playback device.
     (c) "Television" does not include:
     (i) Computer monitors, meaning analog or digital devices designed primarily for displaying computer-generated signals and not marketed for use as televisions; or
     (ii) Televisions with screen areas greater than one thousand four hundred square inches.
"

     On page 10, after line 31 of the amendment, insert the following:
     "(12) Televisions manufactured on or after January 1, 2011, must meet energy efficiency and testing requirements adopted by the California Energy Commission on November 18, 2009, and published in CEC-400-2009-023-CMF. This subsection applies only as provided in section 5 of this act."

     On page 12, after line 16 of the amendment, insert the following:
     "(8)(a) No new television, if manufactured on or after January 1, 2011, may be:
     (i) Sold or offered for sale in the state unless the efficiency of the new television meets or exceeds the efficiency standards set forth in RCW 19.260.040; or
     (ii) Installed for compensation in the state on or after January 1, 2012, unless the efficiency of the new television meets or exceeds the efficiency standards in RCW 19.260.040.
     (b) This subsection (8) applies only as provided in section 5 of this act.
"

     On page 12, after line 17 of the amendment, insert the following:

"NEW SECTION.  Sec. 5   By December 1, 2010, the department of commerce shall determine whether television energy efficiency standards and testing methods adopted by the California Energy Commission on November 18, 2009, and published in CEC-400-2009-023-CMF have been published in the California Code of Regulations. If the department of commerce determines that the standards and testing methods have been published in the California Code of Regulations, it shall promptly publish that determination in the Washington State Register and inform the code reviser in writing. Upon such publication, the energy efficiency standards and testing methods are adopted by reference, and RCW 19.260.040(12) and 19.260.050(8) take effect. However, if the department of commerce determines that the standards and testing methods have not been published in the California Code of Regulations, it shall inform the code reviser in writing and submit a report to the legislature regarding the status of proposed standards and testing methods in California and providing recommendations regarding adoption of television energy efficiency standards and testing methods in Washington."

     Renumber the remaining section consecutively and correct any internal references accordingly.

     On page 12, line 24 of the title amendment, after "19.260.050;" strike the remainder of the title and insert "reenacting and amending RCW 19.260.020; and creating a new section."

EFFECT:  Provides that by December 1, 2010, the Department of Commerce (Commerce) must determine whether television (TV) energy efficiency standards and testing methods adopted by the California Energy Commission (CEC) on November 18, 2009, and published in an official CEC document have been published in the California Code of Regulations (and are thus finally effective). If Commerce makes that determination, it must promptly publish notice in the Washington State Register. Upon such publication, the TV energy efficiency standards and testing methods are adopted by reference, and prohibitions regarding noncompliant TVs will take effect in 2011 (sales) and 2012 (installation for compensation).
