Background:
The state building code council (Council) is responsible for maintaining and updating building codes; approving or denying county or city amendments to codes as relate to single family or multifamily residential buildings; developing and adopting any codes relating to the buildings; and proposing budgets for the operation of the state building code council to the Office of Financial Management. There is a building code council account in the state treasury. Funds in this account are to be used for purposes related to the Council. A fee of $4.50 on each permit is collected by counties and cities and is deposited in the account quarterly, as well as an additional surcharge of $2 for each residential unit, but not including the first unit, on each building containing more than one residential unit.
Summary of Bill:
This bill eliminates the building code council account, and all moneys generated from the fees and surcharges in Section 3 would then be deposited in to the general fund.

Fiscal Note: Requested on 1/15/2010.
Effective Date: The bill takes effect 90 days after adjournment of the session in which the bill is passed.
