Background:
Written notices of nonrenewal must be served upon certificated employees on or before May 15 preceding the commencement of the next term. If the Legislature has not passed the Omnibus Appropriations Act by May 15, then such notice must be served no later than June 1. These deadlines are applicable to nonrenewal of both provisional employees and employees under continuing contracts, and apply whether these persons are employed by a school district or an educational service district. If notice of nonrenewal is not timely served on an employee under a continuing contract, the employee is conclusively presumed to have been re-employed for the next ensuing term upon contractual terms identical with those which would have prevailed if the employee's contract had actually been renewed.
The same deadlines also apply with respect to the service of notice for transfer of an administrator.
Summary of Bill:
The June 1 deadline is changed to June 15. It is applicable only when the Legislature has not passed the Omnibus Appropriations Act by May 15.

Effective Date: The bill contains an emergency clause and takes effect immediately.
Staff Summary of Public Testimony:
(In support) This bill provides flexibility to school districts and will allow the districts time to carefully consider the appropriations act and plan accordingly. The bill includes an emergency clause so that the modification regarding the deadline would apply during the current school year if the Omnibus Appropriations Act is not passed out by May 15, 2009. There has been one time in recent history in which the Omnibus Appropriations Act was not passed out by May 15.
