Title: An act relating to technical corrections to the Revised Code of Washington.

Brief Description: Making technical corrections to various statutes at the request of the statute law committee.

Background: The Statute Law Committee, or the Code Reviser, acting with committee approval, makes recommendations and submits legislation to the Legislature concerning deficiencies, conflicts, and obsolete provisions in the statutes.

In the event that during a session of the Legislature, two bills are passed that amend the same section of the code without reference to one another, the Code Reviser, in consultation with the Statute Law Committee, may incorporate all amendments that do not conflict and publish the section of the code.

Summary of Bill: Sections of law that were amended by separate legislation during the same session are reenacted to reflect the Code Reviser's incorporation and merger of the amendments.

Technical corrections are made to reflect correct statutory references.

Appropriation: None.

Fiscal Note: Not requested.

Effective Date: Ninety days after adjournment of session in which bill is passed.

Staff Summary of Public Testimony: PRO: Sometimes the Legislature passes two separate bills that amend the same section of code during the same legislative session. On average this happens 50 or more times per session. The Code Reviser is authorized to merge sections of law that do not directly conflict. Every few years the Code Reviser will draft a bill that takes those sections of law that were amended twice but contained language somewhat difficult to merge together, and provide for your review and approval our best attempt at merging those sections. We are careful to choose sections that do not contain a conflict of purpose and are relatively non-controversial.

OTHER: There is a statute related to the authority of sheriffs to issue a writ. The statutory reference is incorrect and we would like to fix this and will work with the Code Reviser to see if this fix is appropriate to also include in the technical corrections bill.
