AN ACT Relating to repair and reuse of electronic products by registered collectors; and adding a new section to chapter 70.95N RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1 A new section is added to chapter 70.95N RCW
to read as follows:
Only entities registered as collectors with the department may act
as collectors. All covered electronic products received by a
registered collector must be submitted to a plan, except fully
functional covered electronic products. Products that are received by
the registered collector in working order may be sold or donated as
whole products by the collector for reuse. Computer and computer-related products that require minor repairs may be refurbished within
the state to a fully functional covered electronic product by the
registered collector for reuse according to its original purpose.
Registered collectors may use parts gleaned from collected electronic
products for making minor repairs within the state as long as the
remaining parts, components, and units are submitted to a plan.
Collectors may not include covered electronic products that are gleaned
for reuse in the weight totals for compensation by the plan.
Collectors must report to the department the number of covered
electronic products sold or donated by the collector, and if more than
ten units are sold or donated to a single person, then the collector
must provide the department with the name and address of that person
and the quantity sold to that person.
