AN ACT Relating to the interstate compact for adult offender supervision; adding a new section to chapter 9.94A RCW; providing an effective date; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1 A new section is added to chapter 9.94A RCW
to read as follows:
(1) Effective June 1, 2010, Washington state is temporarily
suspending the state's future participation in the interstate compact
for adult offender supervision, for any new offenders requesting to be
relocated to Washington, until such time action is taken and compliance
is made by the compact as a whole and by individual states to comply,
equity is made in the equal exchange of offenders by other states, past
action and behavior of other states that send offenders to the state of
Washington is reviewed, and negotiations and an active role is made by
the compact and the interstate commission to assure that the compact
operates to protect the safety of the people and communities of
Washington and other individual states.
(2) The state of Washington shall continue to meet its obligation
under RCW 9.95.270 and 9.94A.745 to other states for the supervision of
those parolees, probationers, and other offenders that have been
approved to reside in the state of Washington under the interstate
compact on or before June 1, 2010.
(3) During the legislative session of 2011, the legislature shall
review the statute, rules, and regulations relating to the interstate
compact for adult offender supervision to determine whether the state
of Washington shall renew its participation in the interstate compact
for adult offender supervision or suspend its participation
indefinitely.
NEW SECTION. Sec. 2 This act is necessary for the immediate
preservation of the public peace, health, or safety, or support of the
state government and its existing public institutions, and takes effect
June 1, 2010.
