Providing for the safe collection and disposal of unwanted drugs from residential sources through a producer provided and funded product stewardship program.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Finds that: (1) A convenient, safe, secure, and environmentally sound product stewardship program for the collection, transportation, and disposal of unwanted drugs from residential sources may help to avoid accidental poisonings, decrease illegitimate access to drugs that can lead to abuse, and protect our surface and groundwater; and

(2) Producers of those drugs are the best entity to provide and finance the product stewardship program.

Requires every producer of covered products sold in or into Washington state to participate in a product stewardship program for unwanted products from residential sources.

Requires a producer, group of producers, or stewardship organization operating or intending to operate a product stewardship program to submit a product stewardship plan to the department of ecology before engaging in the collection of unwanted covered products.

Requires the department of ecology to: (1) Determine whether the plan complies with this act. If it approves a plan, the department shall notify the applicant of its approval. If it rejects a plan, the department shall notify the applicant of its decision and its reasons for rejecting the plan;

(2) Send a written warning and a copy of the new chapter created in this act and any rules adopted to implement the new chapter to a producer who is not participating in a product stewardship program approved by the department and whose covered product is being sold in or into the state;

(3) Provide on its web site a list of all producers participating in product stewardship programs it has approved and a list of all producers it has identified as noncompliant;

(4) Send a written warning and a copy of the new chapter created in this act and any rules adopted to implement that chapter to a drug wholesaler known to be selling a product in or into the state from producers who are not participating in a product stewardship program or who are not in compliance;

(5) Annually invite comments from health care facilities, health care practitioners, pharmacists, local governments, and citizens on their satisfaction with the services provided by a product stewardship program; and

(6) Consult with the state board of pharmacy on proposed provisions of a product stewardship plan involving the secure collection, tracking, and handling of drugs collected under a product stewardship program.

Creates the pharmaceutical product stewardship program account.

Allows the director of the department of ecology to lend money from the state toxics control account to the pharmaceutical product stewardship account if necessary to ensure that money is available in the pharmaceutical product stewardship program account for the initial administration of the product stewardship program for unwanted drugs from residential sources.

Provides penalties.

Provides that it is the intent of the legislature to amend chapter 42.17 RCW to find that a violation of state law occurs if a person sponsors false statements about candidates in political advertising and electioneering communications when the statements are made with actual malice and are defamatory.

Finds that in such circumstances damages are presumed and do not need to be established when such statements are made with actual malice in political advertising and electioneering communications and constitute libel or defamation per se.

Concerning public health financing.


Declares an intent to help provide local health jurisdictions with a more stable dedicated funding system by authorizing local option revenue sources and creating a single account through which all state funding for public health will be distributed. Further intends that local health jurisdictions receiving state funds be held accountable for the use of those funds based on the minimum standards of public health protection in the state's public health improvement plan.

Requires the secretary of the department of health to: (1) Establish a review process for determining whether a local health jurisdiction is in substantial compliance with the minimum standards for public health protection established under RCW 43.70.520 (public health services improvement plan--performance measures); and

(2) Notify the state treasurer when the secretary finds that a local health jurisdiction is out of substantial compliance established under RCW 43.70.520.

Requires the state treasurer, upon notification, to suspend any distributions made to the jurisdiction until the secretary of the department of health sends notice that the jurisdiction is back in substantial compliance.

Creates the public health improvement account.

Establishing the financial services intermediary.


Directs the department of financial institutions and the department of community, trade, and economic development to jointly establish the financial services intermediary to: (1) Improve the ability of low-income individuals to access and use mainstream financial products offered by financial institutions;

(2) Identify strategies to make more mainstream financial products available to low-income individuals;

(3) Coordinate with financial institutions to leverage the financial resources of low-income individuals served by community-based asset building coalitions to offer mainstream financial services to those individuals;

(4) Consult and cooperate with organizations and government agencies that are already engaged in asset building and financial literacy activities, such as the financial literacy public-private partnership established in RCW 28A.300.450;

(5) Enter into memoranda of agreement with community-based asset building coalitions and financial institutions; and

(6) Perform other duties as deemed appropriate by the intermediary.

Requires the department of financial institutions to track and monitor financial institutions' participation in the programs of the financial services intermediary and share this information with the intermediary.

Requires the Washington state patrol to electronically monitor every offender who is required to register as a sex offender and: (1) Has been classified as risk level III;

(2) Has registered as lacking a fixed residence; or

(3) Has a prior conviction for failure to register as a sex offender; unless the offender is being electronically monitored by the department of corrections.

Provides that the act is null and void if appropriations are not approved.

Creating a raffle-only limited recreational rainbow trout fishery in Spirit Lake.


Authorizes the fish and wildlife commission to establish a limited recreational fishery for rainbow trout in Spirit Lake, located within the Mount St. Helens national volcanic monument. Authorizations to participate in the Spirit Lake fishery must be distributed through a raffle established by the fish and wildlife commission and conducted by the department of fish and wildlife.

Requires the department of fish and wildlife to coordinate with the United States forest service in the design, monitoring, and implementation of any fishery located in Spirit Lake or elsewhere in the Mount St. Helens national volcanic monument, including the arrangement of access to Spirit Lake for the raffle winners.

Requires the department of corrections to: (1) Allow community corrections officers to inspect the person, residence, automobile, or other personal property of an offender, including escapees and absconders, under its supervision in the community whenever the community corrections officer, based on the officer's professional judgment and discretion, has reasonable cause to believe that the offender has violated a condition or requirement of his or her sentence;

(2) Allow community corrections officers, based on the officer's professional judgment and discretion, to perform random, unannounced inspections of the person, residence, automobile, or other personal property of every offender, including escapees and absconders, under the department's supervision pursuant to a term of community custody imposed for a crime committed on or after August 1, 2009;

(3) Develop a plan, using the existing staffing matrix, to reduce the supervision caseload of community corrections officers by December 1, 2010, and increase partnerships such as the neighborhood corrections initiative; and

(4) Prior to 2010, hire additional community corrections officers to the extent funding is provided in the operating budget.

Provides that the act is null and void if appropriations are not approved.

Addressing motor carrier regulation and compliance review.


Provides that the utilities and transportation commission is responsible for adoption and enforcement of safety requirements for vehicles operated by entities holding authority under RCW chapters 81.66 (transportation for persons with special needs), 81.68 (auto transportation companies), 81.70 (passenger charter carriers), and 81.77 (solid waste collection companies), and by household goods carriers holding authority under chapter 81.80 RCW (motor freight carriers).

Requires all entities with authority under chapters 81.66, 81.68, 81.70, and 81.77 RCW, and all household goods carriers with authority under chapter 81.80 RCW, to apply for a department of transportation number by January 1, 2010.

Requires motor vehicles operated by entities with authority under chapters 81.66, 81.68, 81.70, and 81.77 RCW, and by household goods carriers operating under chapter 81.80 RCW, to comply with rules regulating vehicle safety adopted by the utilities and transportation commission.

Revises penalties for motor carriers.

Doubles the penalty amount for high-risk carriers that have repeat violations of the same violation during a follow-up compliance review.

Authorizes motor carriers, except for high-risk carriers, to request penalty mitigation.

Finds that the derelict vessel removal program has proven highly successful. A vessel generally becomes abandoned or derelict after a long chain of legal ownership transactions in which successive owners either lack the inclination or financial resources to properly maintain the vessel and pass it along in progressive stages of decline. The result is a decrepit vessel selling for nominal cost to someone who cannot bring it back to a safe working condition, or properly dispose of it. The vessel often becomes abandoned or derelict, resulting in cost to the state for removal and disposal.

Authorizes the department of natural resources to create a pilot vessel amnesty disposal program to prevent vessels from becoming abandoned or derelict and to address this issue when it is less expensive and poses fewer threats.

Allows the department of natural resources to expend two hundred thousand dollars, or as much thereof as may be necessary, from any money appropriated to the department from the derelict vessel removal account in the omnibus appropriations act for the biennium ending June 30, 2011, for the purposes of the act.

Expires June 30, 2011.
