(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Finds that: (1) Washington's growing population and economy will put a strain on energy supplies and threaten the ability of the state to meet its climate policy goals unless specific steps are taken to reduce demand and utilize energy more efficiently; and

(2) Solar water heaters can provide at least one-half of the hot water needs in the average home and reduce electric or natural gas consumption with free renewable energy from the sun.

Declares an intent to facilitate the installation of solar water heating systems in homes and businesses by providing: (1) A rebate to customers who install solar water heating systems; and

(2) A tax credit to the light and power business based on the amount of solar water heating systems installed by their customers.

Finds that the rebate and tax credit has broad application for the installation of solar water heating systems in urban, rural, business, and residential locations, as well as in any climate throughout the state.

Expires December 31, 2012.

Declares an intent to help provide local health jurisdictions with a more stable dedicated funding system by creating a single account through which all state funding for public health will be distributed.

Declares that local health jurisdictions receiving state funds be held accountable for the use of those funds based on the minimum standards of public health protection in the state's public health improvement plan.

Directs the secretary of the department of health to establish a review process for determining whether a local health jurisdiction is in substantial compliance with the minimum standards for public health protection established under RCW 43.70.520.

Requires the secretary of the department of health to notify the local health jurisdiction, in writing, and the state treasurer when the secretary finds that a local health jurisdiction is not in substantial compliance with the minimum standards for public health protection established under RCW 43.70.520.

Authorizes the secretary of the department of health to exempt a local health jurisdiction from the review process if the jurisdiction is accredited by an organization whose accreditation standards meet or exceed the minimum standards for public health protection established under RCW 43.70.520.

Creates the public health improvement account.

Authorizing a peer mentoring pilot program at Western Washington University and a community or technical college.


Requires Western Washington University to create and implement a pilot mentoring program to inspire academic success and introduce elementary students to educational opportunities. In addition to establishing a pilot project on its own campus, the university, in close collaboration with the state board for community and technical colleges, shall jointly identify a community or technical college to participate in the pilot program. The university and the state board shall identify the community or technical college by August 1, 2009.

Requires the higher education coordinating board, to the extent funds are appropriated for this specific purpose and within overall appropriations for the state work study program, to award grants to eligible institutions participating in the mentoring pilot project.

Prohibits the department of natural resources, the department of fish and wildlife, and the department of ecology from prohibiting, conditioning, penalizing, or requiring mitigation of a flood control district, a diking district, or a county legislative authority operating under the act when removing gravel from streams or other watercourses for flood control or flood impact reduction purposes.

Directs the department of social and health services to: (1) Maintain a federal waiver through which services may be provided to allow children with developmental disabilities and intense behaviors to maintain permanent and stable familial relationships; and

Authorizes the department of ecology to: (1) Increase fees up to the fiscal growth factor for fiscal years 2010 and 2011, except there may be no increase in fees for fiscal year 2010 or 2011 for categories of dischargers whose fees exceed the costs of managing their permits; and

(2) Adjust the fee schedule annually through December 31, 2011.

Declares an intent to: (1) Modify the common law implied warranty of habitability to provide that this warranty may not be contractually disclaimed, waived, modified, or limited; and

(2) Establish a worker certification requirement for those doing construction work in the areas of roofing, siding, framing, foundations, doors, and windows.

Creates the office of consumer education for home construction in the office of the attorney general to be the primary point of contact for consumers in matters related to residential construction.

Requires a construction professional involved in the construction of new residential real property, or the substantial remodel of existing residential real property, to warrant that the work and any part thereof, will be suitable for the ordinary uses of real property of its type.

Requires any person applying for a building permit for construction of a residential building or substantial remodel to submit building enclosure design documents to the appropriate building department prior to the start of construction or substantial remodel.

Requires a registered contractor, by or against whom a petition in bankruptcy has been filed, to notify the department of labor and industries of the proceedings in bankruptcy, including the identity and location of the court in which the proceedings are pending, within ten days of the filing.
