Expanding the riparian open space program to include lands that contain critical habitat of threatened or endangered species.

Requires the forest practices board to establish by rule a program for the acquisition of riparian open space and critical habitat for threatened or endangered species as designated by the board. At the landowner's option, acquisition may be of a fee interest or a conservation easement. Lands eligible for acquisition are forest lands within unconfined channel migration zones or forest lands containing critical habitat for threatened or endangered species as designated by the board.

Regarding the transfer of certain state forest lands.

Finds that the revenue generated from state forest lands is a vital component of the operating budget in many rural counties. The dependence on a natural resource-based economy is especially underscored in counties with lower population levels and large holdings of public land. The high cost of compliance with the federal endangered species act on state forest lands within these smaller counties is disproportionately burdensome when compared to their total county budgets.

Declares an intent to provide sustainable revenue to smaller counties that are heavily dependent on state forest land revenues while promoting long-term protection, conservation, and recovery of marbled murrelets and northern spotted owls.

In providing these incentives, the legislature hopes to encourage all employers to provide health coverage to employees and dependents, but also ensure that all employers have an opportunity to adopt employee wellness programs for the use of their employees to promote wellness.

Authorizes a small business or a nonprofit organization to claim a business and occupation tax credit for the costs of implementing a qualified employee wellness program.

Abolishing the department of social and health services and creating new departments to take over its functions.


Abolishes the department of social and health services effective July 1, 2011, and creates: (1) The department of economic services, which will conduct financial eligibility evaluations for all the newly created agencies;

(2) The department of medical assistance;

(3) The department of health and rehabilitative services, which will consist of the long-term care, developmentally disabled, vocational-rehabilitation, mental health, and drug and alcohol substance abuse programs, and the special commitment center; and

(4) The department of children's services.

Directs the office of financial management and the department of social and health services to develop a plan to implement the act and report to the legislature during the 2010 legislative session.

Directs the code reviser to propose changes to the Revised Code of Washington for the 2012 legislative session to make technical corrections necessary as a result of implementing the act.

Requires the governor, by July 1, 2009, to appoint a transition team to direct the details of administration of the act.

Requires the transition team, by January 1, 2010, to submit a plan and necessary implementing legislation to the legislature for the division of the department of social and health services so that the new agencies will be operating by July 1, 2011.

Regarding the governance of intercounty rural library districts.


Authorizes the legislative authority of a county comprising part of an intercounty rural library district to, by resolution, submit a request to the county auditor calling for an election to be held in the county for the purpose of determining whether the county shall withdraw from the library district. If a majority of the persons voting on the proposition vote in favor of withdrawing the county from the library district, the county shall cease to be a part of the intercounty library district. A pro rata portion of all property, assets, and liabilities of the library district shall be transferred to the rural library district of the withdrawing county.

Declares an intent to increase incentives for appropriate and successful participation in evidence-based juvenile offender programs in order to further reduce juvenile offender recidivism, reduce crime, and increase fiscal benefits to the state.

Requires the department of social and health services juvenile rehabilitation services administration, to the extent that funds are specifically appropriated for this purpose, to establish a pilot program to promote increased participation and success in juvenile offender evidence-based programs for juveniles under the jurisdiction of a county or the department, and their families.

Requires the pilot program to be operational by March 1, 2010.

Provides that the act is null and void if appropriations are not approved.

Expires June 30, 2014.

Regarding the governance of intercounty rural library districts.


Authorizes the legislative authority of a county comprising part of an intercounty rural library district to, by resolution, submit a request to the county auditor calling for an election to be held in the county for the purpose of determining whether the county shall withdraw from the library district. If a majority of the persons voting on the proposition vote in favor of withdrawing the county from the library district, the county shall cease to be a part of the intercounty library district. A pro rata portion of all property, assets, and liabilities of the library district shall be transferred to the rural library district of the withdrawing county.

Declares an intent to use a portion of the tax revenues that are generated by the tourism industry for the acquisition of Washington state ferry system auto ferry vessels.

Requires the department of transportation to purchase ferry vessels to be used in a county with a population of one million or more using the revenues generated in section 3(3)(d) of the act to pay the principal and interest on any bonds used to purchase the vessels.
