Concerning health benefit plan coverage of neurodevelopmental therapies.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Finds that access to appropriate early intervention services significantly improves function in children with developmental delays and developmental disabilities. Health care services, including neurodevelopmental therapies, are an essential component of early intervention services.

Requires each health plan offered to public employees and their covered dependents under chapter 41.05 RCW that is established or renewed on or after January 1, 2011, to include coverage for neurodevelopmental therapies for covered individuals under eighteen years of age.

Requires all group health benefit plans entered into, or renewed, on or after January 1, 2011, to include coverage for neurodevelopmental therapies for covered individuals under eighteen years of age.

Directs the department of health to: (1) Conduct a review under chapter 18.120 RCW (regulation of health professions--criteria) to determine the most appropriate means to regulate persons who utilize applied behavior analysis for the treatment of persons with an autism spectrum disorder; and

(2) Establish a process to periodically review credible sources of scientific evidence related to effective therapies for treatment of individuals under eighteen years of age with autism spectrum disorder.

Providing real estate excise tax exemptions to stabilize neighborhoods.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Finds that: (1) There is a substantial inventory of unsold or foreclosed vacant homes on the market that is driving property values down and destabilizing neighborhoods; and

(2) Providing targeted incentives to housing developers will stimulate the sale of these vacant homes to low-income buyers now and stabilize neighborhoods affected by this growing inventory.

Declares an intent to provide such incentives through excise tax relief on sales of homes to low-income first-time homebuyers.

Provides a real estate excise tax exemption on the sale: (1) Of a qualifying residential housing unit to a buyer meeting certain conditions and requirements; and

(2) To a qualifying organization where the organization is exercising an option to repurchase the property.

Expires the exemption on July 1, 2013.

Expanding the rights and responsibilities of state registered domestic partners.

Declares that for all purposes under state law, state registered domestic partners shall be treated the same as married spouses. Any privilege, immunity, right, benefit, or responsibility granted or imposed by statute, administrative or court rule, policy, common law or any other law to an individual because the individual is or was a spouse, or because the individual is or was an in-law in a specified way to another individual, is granted on equivalent terms, substantive and procedural, to an individual because the individual is or was in a state registered domestic partnership or because the individual is or was, based on a state registered domestic partnership, related in a specified way to another individual.

Provides that the act shall be liberally construed to achieve equal treatment, to the extent not in conflict with federal law, of state registered domestic partners and married spouses.

Establishes the Washington state center for childhood deafness and hearing loss to provide statewide leadership for the coordination and delivery of educational services to children who are deaf or hard of hearing.

Abolishes the state school for the deaf and transfers its powers, duties, and functions to the Washington state center for childhood deafness and hearing loss.

Requires the director of the Washington state center for childhood deafness and hearing loss to convene an advisory panel for the purpose of implementing in two educational service districts a structured program for delivering education services to children who are deaf and hearing impaired. The panel shall jointly select and consult with two educational service districts as the demonstration sites, one of which shall be in eastern Washington. The advisory panel expires January 1, 2010.

Revitalizing student financial aid.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Declares that it is the intent of the legislature: (1) To promote and expand access to state financial aid programs by determining which programs provide the greatest value to the largest number of students, and by fully supporting those programs;

(2) To designate all existing financial aid an opportunity fund, with the effect of providing students with a clear understanding of available resources to pay for postsecondary education, thereby increasing access to postsecondary education and meeting the needs of local business and industry;

(3) That the higher education coordinating board, the state board for community and technical colleges, the office of the superintendent of public instruction, the workforce training and education coordinating board, and the institutions of higher education coordinate the development of outreach tools, such as a web-based portal for information on all opportunity fund aid programs;

(4) For institutions of higher education to incorporate this information in promotional materials to prospective and current students and their families;

(5) To consolidate the educational opportunity grant program over a period of two years;

(6) To change eligibility requirements of the Washington scholars program; and

(7) To redirect any cost savings gained through changes in eligibility criteria to the Washington scholars program to the state work-study program.

Repeals chapter 28B.101 RCW (educational opportunity grant program--placebound), effective August 1, 2011.

Authorizing a property tax levy to reimburse taxing districts for property taxes refunded under chapter 84.69 RCW and property taxes abated under RCW 84.70.010.


Authorizes taxing districts other than the state to levy a tax upon all the taxable property within the district for certain purposes.

Provides that the act applies retroactively to January 1, 2009, and applies to taxes levied under section 1 of the act for collection in 2010 and thereafter.

Directs the superintendent of public instruction and the department of early learning to convene an early learning working group to recommend a program of early learning for at-risk children, along with a program delivery and governance structure and funding model.

Directs the state board of education to continue development of a comprehensive school and school district accountability system, including identifying the resources and support mechanisms necessary to implement the system.

Directs the office of financial management and the superintendent of public instruction to convene a local finance working group to develop options for a new system of supplemental school funding through local school levies and local effort assistance.

Directs the superintendent of public instruction and the education research and data center to convene a data working group to create a needs requirement document detailing the specific information and technical capacity needed for comprehensive education data systems and to develop a proposal for a data governance structure and identify the costs of implementing the data systems.

Finds that: (1) Healthy wildlife populations are a valuable and treasured public resource to the people of the state of Washington. However, as the human population increases and encroaches on wildlife habitat, interactions between humans and wildlife will become more frequent;

(2) Interactions between humans and wildlife can have significant financial impacts on the affected landowner;

(3) The commercial agriculture, horticulture, and livestock industries are important components of the state economy that can be negatively impacted by interactions with wildlife. However, other landowners, both commercial and residential, may be faced with wildlife interactions that result in property damage;

(4) It is in the best interests of the state for the department of fish and wildlife to respond quickly to wildlife damage complaints and to work with those affected to prevent and minimize negative interactions while maintaining healthy wildlife populations; and

(5) Negative wildlife interactions can be best reduced by encouraging landowners to contribute, through their land management practices, to healthy wildlife populations and to provide access for related recreation.

Declares an intent to provide a solution where all property owners have a potential avenue to petition the state for some mitigation of the damages caused by wildlife.

Provides that the act applies prospectively only and not retroactively. The act applies only to claims that arise on or after July 1, 2010. Claims under chapter 77.36 RCW (wildlife damage) that arise before July 1, 2010, must be adjudicated under chapter 77.36 RCW as it existed before July 1, 2010.

Expires section 12 of the act on July 30, 2014.
