Concerning continuity of child care.

Declares an intent to direct the development for a plan to reform components of Washington's subsidized child care system in order to implement a system of subsidized child care that promotes continuity of care for children and that is aligned with the state's philosophy and goals regarding early learning and school-age programs, is affordable for parents needing financial assistance, and is uncomplicated and predictable for providers.

Requires the department of early learning, jointly with the economic services administration of the department of social and health services, to collaborate with stakeholders from early learning and school-age programs serving families receiving working connections child care subsidies and prepare a plan to implement the policies in the act for administering the working connections child care program.

Adds language to the notice to parents regarding shelter care hearings and the child dependency process.

Requires the department of social and health services, after entry of a dispositional order pursuant to RCW 13.34.130 ordering placement of a child in out-of-home care, to continue to encourage the parent, guardian, or custodian of the child to engage in services and maintain contact with the child, which shall be accomplished by attaching a standard notice to the services and safety plan to be provided in advance of hearings.

Requires the court, in determining placement, to weigh the child's length of stay and attachment to the current provider in determining what is in the best interest of the child.

Permits the dependency court to consider a parent's failure to have contact with a child for fifteen consecutive months when the court is analyzing whether aggravated circumstances exist.

Providing certain procedures for tenants who are victims of sexual assault, unlawful harassment, and stalking.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Authorizes a tenant, if a tenant or a household member is a victim of sexual assault, stalking, or unlawful harassment by a landlord, to: (1) Terminate the rental agreement and quit the premises without further obligation under the rental agreement or under chapter 59.12 RCW (forcible entry and forcible and unlawful detainer) prior to making a copy of a valid order for protection or a written record of a report signed by a qualified third party available to the landlord, if certain conditions are met; and

(2) Change or add locks to the tenant's dwelling unit at the tenant's expense.

Prohibits a tenant from changing any locks to common areas and requires the tenant to make keys for new locks available to other household members.

Requires a tenant, upon vacating the dwelling unit, to deliver the key and all copies of the key to the landlord by mail or personal delivery by a third party.

Regarding the feeding of wildlife.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Declares an intent to protect wildlife from becoming habituated to humans and to protect the public against the serious health and safety risk posed by wildlife that are drawn into contact with humans and related infrastructure by individuals who intentionally feed wildlife.

Prohibits a person from placing, depositing, distributing, or scattering grain, hay, or other food so as to intentionally constitute a lure, attraction, or enticement for potentially habituated wildlife not lawfully held in captivity.

Prohibits an individual from being issued a warning or a natural resources infraction under section 2 of the act for feeding elk in the Mt. St. Helens elk herd management area, as identified in the Washington state elk herd plan prepared by the department in May 2006, until July 31, 2019.

Penalizes a person who intentionally feeds potentially habituated wildlife in violation of a written warning under section 2 of the act.

Requires the priorities set by the group to consider policies for the state's higher education system to achieve growth and manage existing assets in a responsible manner, biennial budget projections for capital expenditures, and biennial budget projections for student full-time equivalent growth.

Allows up to ten percent of the funds provided to counties from the criminal justice treatment account to be used for the operation and administration of drug court programs, in addition to the use of such funds for treatment and support services for offenders.

Removes the requirement of matching funds for state moneys provided to counties for drug court programs where the money is authorized for administration and operation of the drug court programs.

Expires the authorization of money allocated from the account to operation and administration of drug court programs on June 30, 2013.

Declares an intent to promote a greater focus, in permanency planning and adoption proceedings, on the interests of siblings separated by adoptive placements and to encourage the inclusion in adoption agreements of provisions to support ongoing postadoption contact between siblings.

Directs the court, in reviewing and approving an agreement under RCW 26.33.295 for the adoption of a child from foster care, or whenever the permanency plan for a child is adoption, to encourage the prospective adoptive parents, birth parents, foster parents, kinship caregivers, and the department of social and health services or other supervising agency to seriously consider the long-term benefits to the child adoptee and his or her siblings of providing for and facilitating continuing postadoption contact between the siblings.

Directs the early learning advisory council, in collaboration with the office of the superintendent of public instruction, to convene a work group to develop and field test a statewide kindergarten assessment process to: (1) Provide parents and teachers with information about a child's knowledge, skills, and abilities upon entering kindergarten in order to inform instruction for the child;

(2) Facilitate communication with parents about what children are learning and to empower parents to assist their children; and

(3) Provide feedback to early learning programs to enable continuous improvement, support transitions, and improve alignment between early learning programs and kindergarten classrooms.

Requires the kindergarten assessment process to be field-tested in selected schools and districts during the 2010-11 school year.

Requires the office of the superintendent of public instruction to encourage all school districts to implement the statewide kindergarten assessment process beginning in the 2011-12 school year.

Declares that it is the intent of the legislature that state funded capital projects create a net gain in economic activity, limit land use patterns that contribute to the production of greenhouse gases, and result in certain benefits to communities and the business environment.

Requires the public works board, in awarding loans, to consider whether the local government has adopted policies to reduce greenhouse gas emissions that at least include policies consistent with certain requirements.

Requires the community economic revitalization board to: (1) In awarding loans and grants, consider whether the applicant has adopted policies to reduce greenhouse gas emissions that at least include policies consistent with certain requirements; and

(2) As part of the approval process, consider whether the sponsoring local government has adopted policies to reduce greenhouse gas emissions that at least include policies consistent with certain requirements.

Requires the transportation improvement board, under certain conditions, to consider the land use implications of a project, such as whether the programs and projects are located in jurisdictions that have adopted policies to reduce greenhouse gas emissions that at least include policies consistent with certain requirements.

Creates the residential infrastructure program in the department of community, trade, and economic development to provide loans to eligible jurisdictions and grants to nonprofit organizations for public infrastructure that supports increased capacity for dense, affordable residential development in transit-proximate areas.

Authorizes the department of community, trade, and economic development to provide direct loans to eligible jurisdictions for projects meeting certain requirements or to provide grants to nonprofit organizations for projects meeting certain requirements.

     Requires the department of community, trade, and economic development to: (1) Determine each year the total amount of funding available in loans and grants and each county's share based on the percentage of statewide real estate excise tax collections that came from the county, and establish the total amount of financial assistance to be appropriated to eligible jurisdiction and nonprofit organization applicants in each county;

(2) Announce to all known interested parties, and through major media throughout the state, a competitive application period for each county of at least ninety days' duration; and

(3) Establish a competitive process for loan and grant awards within each county and review and prioritize proposals in consultation with the public works board and the transportation improvement board or designees selected by those boards to represent them, as well as county government.

Creates the residential infrastructure account.

Directs the state treasurer to transfer the excess real estate excise tax growth amount from the general fund to the residential infrastructure account and the public facilities construction loan revolving account.

Requires the director of the office of financial management to notify: (1) The state treasurer of the amount to be transferred to the residential infrastructure account and the public facilities construction loan revolving account; and

(2) The department of community, trade, and economic development of the county by county breakdown of real estate excise tax collections.

Modifies distribution of the excise tax upon each sale of real property.

These practices may be dangerous when improper sterilization techniques are used, presenting a risk of infecting the client with bloodborne pathogens including, but not limited to, HIV, hepatitis B, and hepatitis C. It is in the interests of the public health, safety, and welfare to establish requirements in the commercial practice of these activities in this state.

Requires a school district or educational service district to purchase basic benefits as defined in section 1 of the act for employees and dependents through the state health care authority, except that the coverage may be purchased through other parties if required by any collective bargaining agreement signed before the effective date of the act.

Requires the state health care authority to explore opportunities to change the start of the benefit year to September to accommodate the September 1, 2011, merger of school districts and educational service districts.

Authorizes school districts and educational service districts to: (1) Contractually agree with the state health care authority to benefits eligibility criteria which differs from that determined by the public employees' benefits board; and

(2) Collect additional contributions from part-time employees not to exceed the cost of the benefits provided to these employees.

Requires the department of social and health services, beginning with the 2019-2021 fiscal biennium, and in every fiscal biennium thereafter, to adjust the child care subsidy to make it equal to or greater than seventy-five percent of the actual charges of providing child care in a child care center.

Requires child care centers to: (1) Respond to any reporting requirements adopted by the department of social and health services or the department of early learning, including requirements on reporting attendance or absences of children in their centers; and

(2) Distribute age-appropriate educational and parenting information provided by licensors, local resource centers, school districts, and other organizations to parents who bring their children to that child care center.

Directs the Washington basic health plan administrator to reserve ten percent of enrollment slots for child care providers working at child care centers that are licensed by the state under RCW 74.15.030 and have at least one child care slot filled by a child for whom it receives a subsidy.

Requires the department of social and health services, within current funding levels, to place on the public web site maintained by the department a document listing the duties and responsibilities the department has to a child subject to a dependency petition.

Requires the social worker assigned to the case, once a dependency is established under chapter 13.34 RCW (juvenile court act) to: (1) Provide the dependent child with a document containing certain information; and

(2) Explain the content of the document to the child and direct the child to the department's web site for further information.

Requires the court to ensure that a dependent child over the age of twelve, who is otherwise present in the courtroom, is aware of and understands the duties and responsibilities the department of social and health services has to a child subject to a dependency.
