On page 9, beginning on line 5, after "(o)" strike all material
through "locations." on line 11 and insert "Each nonprofit patient
cooperative shall be operated as a completely independent entity. A
nonprofit patient cooperative shall not share with any other nonprofit
cooperative ownership of plants, cannabis, or proceeds. This
requirement does not preclude a nonprofit patient cooperative from
operating out of multiple locations or selling or buying goods and
services to or from other nonprofit patient cooperatives.
(p) Nonprofit patient cooperatives must collect and remit to the
department of revenue all applicable state and local taxes on sales of
medical cannabis."
On page 16, beginning on line 26, after "provider" strike all material through "cannabis or" on line 28
EFFECT: Corrects a typographical error. Changes language prohibiting nonprofit patient cooperatives from being located within five hundred feet of a "community center" or "child care center" to prohibiting a nonprofit patient cooperative from being within five hundred feet of a "community center owned by a county or municipal corporation" or a "day care center." Clarifies that while nonprofit patient cooperatives may not be affiliated, they may buy or sell goods or services to other nonprofit patient cooperatives. Adds language requiring nonprofit patient cooperatives to collect and remit any applicable taxes. Clarifies that qualifying patients and designated providers are provided with an affirmative defense if they have valid documentation at the time of their arrest.
