     AN ACT Relating to payment for critical services rendered by out-of-network providers in in-network hospitals; and adding a new section to chapter 48.43 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1   A new section is added to chapter 48.43 RCW to read as follows:
     (1)(a) A hospital with an emergency department shall post in a conspicuous manner in its reception area a sign indicating whether the providers in the emergency department are nonparticipating providers with any of the health carriers with whom the hospital participates. A hospital is not required to comply with this requirement if the providers in its emergency department participate with all of the carriers with whom the hospital participates.
     (b) A hospital with an emergency department shall provide the information required in (a) of this subsection to every patient receiving emergency services in the emergency department, or the patient's representative, when obtaining informed consent for the emergency services. The hospital is not required to comply with this subsection if to do so would endanger the life or health of the patient.
     (c) A hospital that does not comply with the requirements of this section shall promptly reimburse the patient for any amount billed to the patient by a nonparticipating provider for emergency services, with the exception of any applicable cost sharing.
     (2)(a) In any explanation of benefits sent to a covered person, a health carrier shall inform the covered person:
     (i) Whether any covered emergency services were provided by a nonparticipating provider;
     (ii) That the covered person may be subject to billing by the nonparticipating provider for the difference between the amount paid by the health carrier and the provider's billed charges; and
     (iii) That the amount billed by the nonparticipating provider is often subject to negotiation and that the covered person may wish to contact the provider about the bill.
     (b) A health carrier that does not comply with (a) of this subsection shall promptly reimburse the covered person for any amount billed to the patient by a nonparticipating provider for emergency services, with the exception of any applicable cost sharing.
     (3)(a) A nonparticipating provider who bills a covered person for emergency services shall inform the person in writing that:
     (i) The amount in the bill may not be reflective of the provider's actual costs and may be subject to negotiation; and
     (ii) The covered person may not be responsible for paying the amount under subsection (1)(b) or (2)(b) of this section.
     (b) A nonparticipating provider who does not comply with this subsection (3) shall promptly refund any amounts collected from the covered person, with the exception of any applicable cost sharing. Failure to provide a refund to the covered person constitutes unprofessional conduct under chapter 18.130 RCW.
