AN ACT Relating to persons who operate a roll your own cigarette machine at retail establishments; adding a new section to chapter 70.158 RCW; and adding a new section to chapter 70.155 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1 A new section is added to chapter 70.158 RCW
to read as follows:
For the purposes of this chapter and chapters 70.157 and 82.24 RCW,
every owner or retailer who maintains a machine at a retail
establishment that enables a person to process a product made or
derived from tobacco into a roll or tube shall be deemed to be a
manufacturer of cigarettes. The resulting product shall be deemed to
be a cigarette.
NEW SECTION. Sec. 2 A new section is added to chapter 70.155 RCW
to read as follows:
A retailer may allow a person to process a product made or derived
from tobacco into a roll or tube by use of a machine. A retailer is
prohibited from permitting the use of the machine by a person:
(1) With tobacco, rolls, or tubes that are not purchased from that
retail establishment; or
(2) At a time that is not contemporaneous to the time of the
purchase of the tobacco, rolls, or tubes.
