Creates the office of the superintendent of public instruction as an executive branch agency.

Provides that the act takes effect January 13, 2012, if the proposed amendments to Article III of the state Constitution, eliminating the superintendent of public instruction as a statewide elected official, is approved by the voters at the next general election.
