On page 3, beginning on line 4, strike all of subsection (3)(c) and
insert the following:
"(c) A county, city, or town with an impact fee deferral process
on, or before, December 1, 2013, is exempt from the requirements of
this subsection (3) if the deferral process, which may be amended in a
manner consistent with this subsection (3), delays impact fees and
remains in effect after December 1, 2013.
(d) A county, city, or town that collects impact fees may not defer
any portion of the impact fee collected for school facilities."
EFFECT: Clarifies the exemption for counties, cities, and towns
that have preexisting impact fee delay processes from the obligation to
establish an impact fee deferral system.
Exempts school impact fees.
