On page 3, beginning on line 24 of the amendment, after "(5)" strike all material through "department." on line 26 and insert "No civil liability may be imposed by any court on the state or its officers and employees for any adverse impacts resulting from a fish enhancement project permitted by the department under the criteria of this section except upon proof of gross negligence or willful or wanton misconduct."
EFFECT: Creates immunity from civil liability for the state or its officers and employees for harm caused by fish enhancement projects permitted under the streamlined hydraulic project approval process unless the harm is caused by gross negligence or willful or wanton misconduct.
