AN ACT Relating to reservations of water; adding a new section to chapter
90.54 RCW; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 90.54 RCW to read as follows:
(1) The department shall act on all water rights applications which may rely on reservations of water established under the authority of RCW
90.54.020(3)(a) included in a rule setting minimum instream flows and levels for water resource inventory area 45, chapter 173-545 WAC, as it existed on the effective date of this section. The legislature declares that the rule to which this section applies is consistent with legislative intent and is specifically authorized to be maintained and implemented by the department.
(2) This section does not affect the department's authority to adopt, amend, or repeal rules establishing minimum instream flows and levels.
(3) This section may not be construed to prejudice any reservations of water included in any rule not covered by this section.
NEW SECTION. Sec. 2. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and takes effect immediately.
