(DIGEST AS ENACTED)

Prohibits a manufacturer, wholesaler, or retailer from manufacturing, selling, or distributing, for sale or use in this state, children's products or residential upholstered furniture containing any of the following flame retardants in amounts greater than one thousand parts per million in any product component: (1) TDCPP;

(2) TCEP;

(3) Decabromodiphenyl ether;

(4) HBCD; or

(5) Additive TBBPA.

Requires the department of ecology to consider whether the following flame retardants meet the criteria of a chemical of high concern for children: (1) IPTPP;

(2) TBB;

(3) TBPH;

(4) TCPP;

(5) TPP; and

(6) V6.

Requires the department of health, within one year of adopting a rule that identifies a flame retardant in (1) through (6) above as a chemical of high concern for children and in consultation with the department of ecology, to create a stakeholder advisory committee for each flame retardant chemical to provide stakeholder input, expertise, and additional information in the development of certain recommendations.

Exempts the following from chapter 70.240 RCW (children's safe products): The sale or purchase of previously owned products containing a restricted chemical, made in casual or isolated sales, or by a nonprofit organization.
