    On page 2, line 23, after "aircraft," insert "unmanned aerial system,"

    On page 2, line 24, after "yards" insert "as measured in any direction, including vertically,"

    On page 2, line 36, after "(2)" insert the following:

    "It is not a violation of subsection (1)(a) of this section for a person to cause an unmanned aerial system to approach a southern resident orca whale solely by virtue of the unmanned aerial system being in active transit to an unrelated destination.

    Renumber the remaining sections consecutively and correct any internal references accordingly.

    On page 3, line 30, after "section" strike "," and insert "((,)):

(a) "Unmanned aerial system" means an aircraft that is operated without the possibility of human intervention from on or within the aircraft, and any hardware or software associated with its operation; and

(b)"

EFFECT:  Defines "unmanned aerial system," adds it to the list of objects that may not approach a southern resident orca whale within 200 yards, and specifies that the 200-yard prohibition includes vertical distance. Adds an exemption for unmanned aerial systems that are in active transit to an unrelated destination.
