Declares that the state: (1) Finds that the department of social and health services should not engage in the improper and inappropriate reduction of the number of license violations found by field inspectors for the purpose of allowing agency licensees to avoid liability in a manner that permits the violating agency to stay open at the risk of public safety; and(2) Recognizes the need to prohibit sham transfers of licenses between behavioral health licensees found in violation of the terms of their license agreement and their family members.Requires the department of social and health services to issue an annual report to the legislature containing a detailed overview of each settlement agreement entered into between the department and behavioral health licensees concerning the resolution of administrative complaints, license violations, suspensions, and revocations.
SB 5706 by Senators Becker, Rivers, Bailey, Brown, O'Ban, Fortunato, and Warnick Addressing parent-initiated behavioral health treatment for children aged thirteen to seventeen years old. Requires a parent to, during the evaluation of a minor at the request of the parent and during the course of medically necessary treatment commenced pursuant to the evaluation, be considered the personal representative of the minor for the purpose of transmission of medical information, making treatment decisions, and reviewing the compliance of the minor with treatment recommendations. Suspends RCW 71.34.500 through 71.34.530 (certain mental health services for minors) for the limited purpose of this evaluation and course of follow-up treatment, unless the parent agrees to a confidential relationship between the child and the health care provider, or the receipt of new information or a material change in circumstances causes the provider to reevaluate the medical necessity for treatment.
