SB 5202 - DIGEST

Prohibits the issuance of any kind of marijuana-related license to a business entity or nonprofit entity, unless formed under state law or holding a certain certificate of registration.

Requires a person holding more than ten percent interest in the entity to possess the same qualifications required of the licensee, with the exception of any residency requirement.

Authorizes the state liquor and cannabis board to impose additional licensing fees to recover additional costs incurred in investigating a nonresident who is required to be investigated.

Gives discretionary authority to the board to deny a license or license renewal to an entity if, after reasonable efforts, the board is unable to investigate the nonresident, in accordance with the investigatory standards applicable to the investigation of a state resident.
