On page 7, line 6, after "(16)" strike "Any" and insert "((Any)) Except as provided in subsection (17), any"

On page 7, after line 7, insert the following:

"(17) Any person violating subsection (1) or (2) of this section is guilty of a class C felony if the person has a prior conviction for a criminal street gang-related offense, most serious offense, violent offense, or sex offense as those terms are defined in RCW 9.94A.030; or has been sentenced to additional time in total confinement pursuant to RCW 9.94A.533(3) or (4)."

Renumber the remaining subsections consecutively and correct any internal references accordingly.

Correct the title.

EFFECT: Makes a violation of place-based restrictions on weapons a class C felony, instead of a gross misdemeanor, if a person also has a prior conviction for a criminal street gang-related offense, most serious offense, violent offense, or sex offense; or has had additional time in total confinement imposed for commission of a felony while the offender or an accomplice was armed with a firearm or other deadly weapon.
