On page 11, beginning on line 16 of the striking amendment, after "subsection," strike all material through "month" on line 25 and insert "during the first month that the rent is past due, late fees may not exceed two percent of the tenant's total rent per month. During the second consecutive month and all subsequent consecutive months that the rent is past due, late fees are not subject to an upper monthly limit and are cumulative"

On page 22, beginning on line 24 of the striking amendment, after "month" strike all material through "month" on line 28 and insert "and all subsequent consecutive months that the rent is past due, late fees are not subject to an upper monthly limit and are cumulative"

EFFECT: Eliminates the limit on the amount of late fees a landlord may charge during the second consecutive month and all subsequent consecutive months that the rent is past due. Provides instead that such lates fees are not subject to an upper monthly limit and are cumulative.
