On page 17, line 33 of the striking amendment, after "(1)" strike "In" and insert "(a) Excepted as provided in (b) of this subsection, in"
On page 18, after line 3 of the striking amendment, insert the following:
"(b) The causes for vacancy provided in (a) of this subsection do not apply where a county, by ordinance or vote of the electors of that county, opts to not be subject to such causes for vacancy."
On page 19, line 3 of the striking amendment, after "(9)" strike "Whenever" and insert "(a) Except as provided under (b) of this subsection, whenever"
On page 19, after line 8 of the striking amendment, insert the following:
"(b) The causes for vacancy provided in (a) of this subsection do not apply where a county, by ordinance or vote of the electors of that county, opts to not be subject to such causes for vacancy."
| EFFECT: Permits each county, by county ordinance or vote of the electors, to opt not to subject the county's elected sheriff to removal from that office for not maintaining certification, being decertified pursuant to a final decision, or if other eligibility requirements are not met or complied with while in office. |
