AN ACT Relating to giving counties, cities, and towns the first option to lease, rent, or buy surplus school district real property; adding a new section to chapter 28A.58 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 28A.58 RCW to read as follows:

          Whenever school district surplus real property is to be sold, the school district first shall offer to sell the real property to the city, town, or county within which the school district is located, for a ninety-day period prior to offering the real property to another party or to the general public.  The surplus real property shall not be sold to another party until this ninety-day period has elapsed.  Any sale of such real property to a county, city, or town within this ninety-day period shall be conditioned so that if the county, city, or town desires to resell all or part of the property within twenty-five years, it first shall offer to resell the property to the school district.

 

          NEW SECTION.  Sec. 2.     If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.

 

          NEW SECTION.  Sec. 3.     This act is necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.
