AN ACT Relating to agency leases; and adding new sections to chapter 43.88 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 43.88 RCW to read as follows:

          No agency may make a contract of lease for real property, or improvements thereon, in excess of .......... dollars unless the lease has been approved by the office of financial management under section 2 of this act.  Any lease entered into without approval from the office of financial management is null and void.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 43.88 RCW to read as follows:

          (1) Within ten days of receipt of a formal agency request for approval of a lease, the office of financial management shall notify the agency that:

          (a) The lease does not involve a significant expansion of the area served, or the program offered, by the agency and is therefore approved;

          (b) The lease does involve such an expansion and is therefore approved or not approved pursuant to subsection (2) of this section; or

          (c) The office of financial management is not able to determine whether the lease involves such an expansion and the lease is therefore tentatively not approved pursuant to subsection (3) of this section.

          (2) If the office of financial management determines that a lease does involve such an expansion, it shall determine whether the legislature has explicitly authorized the service area or program expansion.  If the office of financial management finds explicit legislative approval for the expansion, it shall immediately approve the lease.  The office of financial management shall not approve the lease if it does not find such explicit legislative approval.

          (3) If the office of financial management is not able to determine within ten days whether a proposed lease involves a significant expansion, the office of financial management shall tentatively not approve the lease and shall request from the agency whatever information it needs to make a final determination.  The office of financial management shall indicate its final approval or disapproval of a proposed lease not later than thirty days following its first receipt of the formal proposal unless the agency notifies the office of financial management in writing that the office of financial management may delay its response for a longer period of time.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 43.88 RCW to read as follows:

          (1) The office of financial management shall adopt rules to implement section 2 of this act.

          (2) The office of financial management shall report to the legislature by January 1st of each year regarding the leases it has allowed under section 2 of this act and all leases it has not approved.
