AN ACT Relating to garnishment for payment of rent; and adding a new section to chapter 7.33 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 7.33 RCW to read as follows:

          (1) A landlord as defined in RCW 59.18.030(2) shall be entitled to obtain a writ of garnishment for payment of rent which is owed to the landlord by a tenant when the procedural requirements of this chapter are satisfied.

          (2) The writ authorized by subsection (1) of this section shall be applicable to funds due to the tenant such as any salary or wages, any entitlements to public assistance payments pursuant to Title 74 RCW, and to any benefits of worker's compensation pursuant to Title 51 RCW.

          (3) A writ of garnishment granted pursuant to this section shall be limited to a maximum amount of twenty percent of the funds due a tenant in any monthly period.
