AN ACT Relating to motor vehicles; adding a new section to chapter 46.64 RCW; and repealing RCW 46.64.060 and 46.64.070.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 46.64 RCW to read as follows:
(1) No law enforcement agency may establish or conduct a roadblock, temporary checkpoint, or other procedure or device for stopping motor vehicles without an individualized determination of probable cause to ascertain whether the drivers of those vehicles are violating a provision of Title 46 RCW or similar local ordinance.
(2) "Law enforcement agency" as used in this section means the Washington state patrol or the law enforcement agency of a county, city, or town.
NEW SECTION. Sec. 2. The following acts or parts of acts are each repealed:
(1) Section 1, chapter 144, Laws of 1967 and RCW 46.64.060; and
(2) Section 2, chapter 144, Laws of 1967, section 1, chapter 22, Laws of 1973 2nd ex. sess. and RCW 46.64.070.
