AN ACT Relating to garnishment; and amending RCW 7.33.090.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. Section 9, chapter 264, Laws of 1969 ex. sess. and RCW 7.33.090 are each amended to read as follows:
The writ of
garnishment shall set forth the amount which garnishee is required to hold
which shall be an amount determined as follows: (1) The amount of (a) the
judgment remaining unsatisfied or (b) if before judgment, the amount prayed for
in the complaint; (2) Plus interest to the date of garnishment at the rate
specified in the contractual document or the statutory rate, if there be no
contractual document; (3) Plus whichever shall be the greater of (((a)))
fifty dollars ((or (b) ten percent of (i) the amount of the judgment
remaining unsatisfied or (ii) the amount prayed for in the complaint. The
court may, by order, upon a showing of good cause by plaintiff, set a higher
amount)) or costs.
