AN ACT Relating to pharmacies; amending RCW 18.64.165; adding a new section to chapter 18.64 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 18.64 RCW to read as follows:

          Any place of business or location at which drugs are dispensed to the ultimate consumer and which place of business or location is not otherwise licensed or registered under this chapter, shall obtain a license upon approval of application made to the board.  The board shall establish an initial license fee and an annual renewal fee.  The board shall establish renewal dates.  The licensee shall immediately notify the board of any change of location or ownership.  The license shall be conspicuously displayed in the place of business.  A violation of this section is a misdemeanor, and each day of a continuing violation constitutes a separate offense.  If a license fee remains unpaid for sixty days, a license shall not be issued except upon payment of the license renewal fee and a penalty fee equal to the license renewal fee.

 

        Sec. 2.  Section 15, chapter 38, Laws of 1963 as amended by section 14, chapter 90, Laws of 1979 and RCW 18.64.165 are each amended to read as follows:

          The board shall have the power to refuse, suspend, or revoke the license of any manufacturer, wholesaler, pharmacy, dispensing place or location, shopkeeper, itinerant vendor, or peddler upon proof that:

          (1) The license was procured through fraud, misrepresentation, or deceit;

          (2) The licensee has violated or has permitted any employee to violate any of the laws of this state relating to drugs, controlled substances, cosmetics, or nonprescription drugs, or has violated any of the rules and regulations of the board of pharmacy.
