AN ACT Relating to contracts for public works and improvements; and adding new sections to chapter 39.04 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 39.04 RCW to read as follows:

          (1) The state and each municipality shall require that all contractors and subcontractors under contracts for public works or improvements agree to participate in a continuing apprenticeship training program approved by and registered with the supervisor of apprenticeship of the department of labor and industries.  As part of the bid specifications for any public works contract, the state or the municipality shall require each contractor and subcontractor to agree to participate in such a program and to submit a copy of his or her certified payroll listing the names of all workers on the project, indicating their status as journeymen or apprentices, the wages paid, apprenticeship registration number, and social security number with each request for payment for work completed.

          (2) Any contractor or subcontractor who has not agreed to participate in the required apprenticeship program within thirty days after the contract has been awarded, or who violates that agreement, shall forfeit the contract and his or her bond.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 39.04 RCW to read as follows:

          (1) The state and each municipality shall require that the bid specifications for all contracts for public works or improvements state the minimum benefits which are to be provided to the workers employed in the performance of the contract by each contractor and subcontractor.  The contract shall specify the minimum prevailing benefits to be provided to workers under the contract, including, but not limited to, health and medical benefits, retirement and pension benefits, vacation, holidays, and sick pay, and approved apprenticeship and training funds under chapter 49.04 RCW.

          (2) Determination of prevailing benefits shall be made by the director of labor and industries in accordance with this section, and the approval of fringe benefit plans and trusts by the director shall be in accordance with the employees' retirement insurance security act as administered by the United States department of labor.
