AN ACT Relating to state government; and creating new sections.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     There is established a fair competition review commission consisting of a chairman selected by the deans of the schools of business at the state universities and sixteen members appointed in the following manner:

          (1) Four members shall be from the senate, two from each major political party, and appointed by the president of the senate;

          (2) Four members shall be from the house of representatives, two from each major political party, and appointed by the speaker;

          (3) Four members shall be appointed by the governor from state employees;

          (4) Four members shall be appointed by the governor from recommendations from business groups as follows:

          (a) One from recommendation of the association of Washington business;

          (b) One from recommendation by the national federation of independent businesses;

          (c) One from recommendation by the independent business association; and

          (d) One from recommendation by the state association of chambers of commerce.

          Members of the commission shall receive no compensation for their service, but shall be reimbursed for travel expenses as provided in RCW 43.03.050 and 43.03.060.  Members of the legislature appointed to the commission shall be reimbursed for travel expenses pursuant to RCW 44.04.120.

 

          NEW SECTION.  Sec. 2.     The fair competition review commission shall:

          (1) Identify those functions of state government that compete with private enterprise;

          (2) Identify cost savings which could be realized if certain services now provided by state agencies were provided by private enterprise;

          (3) Identify the problems of private enterprise when faced with competition from state government agencies and/or competition from nonprofit organizations granted tax exemptions by state government;

          (4) Review cost accounting procedures to determine if state agency activities which could be performed by private enterprise reflect the true and complete costs to the state of each activity;

          (5) Identify possible increases in tax revenue to the state if certain state agency activity was shifted to private enterprise; and

          (6) Identify other issues related directly to the issue of unfair competition.

 

          NEW SECTION.  Sec. 3.     The fair competition review commission shall begin work no later than October 1, 1985.  The commission shall submit an initial report to the legislature and the governor on or before January 1, 1987.  The commission shall cease to exist on July 1, 1989.
