AN ACT Relating to management of public lands; adding a new section to chapter 79.66 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 79.66 RCW to read as follows:

          In the development of land by the department for nonnatural resource income production, full consideration must be given to alternative development strategies.  Prior to designating state lands as urban lands, or purchasing, exchanging, or selling of land through the land bank, or development of land for income production of a nonnatural resource nature, the department of natural resources shall formulate, and submit to the board for approval, a comprehensive action plan regarding the state's land base which is designated as urban, or expected to convert to commercial, residential, or industrial uses within ten years.

          The action plan shall contain methods for analyses of potential rates of return for alternative development strategies, the risk associated with each option, environmental and land use constraints, and the suitability of the property for sale or lease for recreational or aesthetic purposes.  The plan shall include an analysis of appropriate investment levels for improvements to urban lands undertaken by the department of natural resources calculated on a parcel-by-parcel basis using an economic return  analysis, and comparison incorporating the criteria outlined in RCW 79.01.095 for alternative development strategies.  The analysis shall also include alternatives for:  (1) Sale or lease at the present time with no capital investment, using the present fair market value of the property, (2) sale or lease after formulation of a development plan in cooperation with local governments with regulatory authority over the property, and completion of preliminary plat or zoning approval, and the necessary feasibility and engineering  studies, (3) sale or lease upon completion of governmental approvals and the extension of off-site utilities and roads to the property boundary, (4) sale or lease with all on-site work such as grading, utilities, and streets completed  so that the site is ready for immediate construction of buildings by private developers or local governments, and (5) sale and investment of funds by the state investment board to maximize return at a prudent level of risk.

          The plan shall contain a description of the complete decision-making process, from initial identification of a parcel to final board approval of an action on a parcel, for each individual parcel of land considered for nonnatural resource income production.

 

          NEW SECTION.  Sec. 2.     This act is necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.
