AN ACT Relating to the state arts commission; and making an appropriation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     (1) There is appropriated from the state general fund to the state arts commission for the biennium ending June 30, 1987, the sum of one million dollars, or so much thereof as may be necessary, to carry out the purposes of this section.

          (2) Moneys appropriated by this section shall be allocated by the state arts commission to organizations that:

          (a) Qualify as an artistic and cultural organization under RCW 82.04.4328;

          (b) Provide matching funds equal to the amount allocated to the organization by the commission; and

          (c) Agree to place the allocated moneys and matching funds in a separate endowment trust fund from which the organization may expend only interest income and not principal.

          (3) The commission shall adopt rules governing the procedures and criteria for allocations under this section.  At least two-thirds of the amount appropriated by this section shall be allocated to organizations having annual operating budgets in excess of three hundred thousand dollars.

          (4) An organization receiving an allocation under this section may return all or a portion of the allocation to the state general fund at any time.  All allocated moneys shall be returned if the organization fails to comply with this section or the rules of the commission.

 

          NEW SECTION.  Sec. 2.     If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.
