AN ACT Relating to nursing homes; and amending RCW 18.51.030.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  Section 4, chapter 117, Laws of 1951 and RCW 18.51.030 are each amended to read as follows:

(1) After July 1, 1951 no person shall operate or maintain a nursing home in this state without a license under this chapter.

(2) Any nursing home providing home-delivered nursing services pursuant to RCW 18.51.010(5)(a) to patients who have received convalescent or chronic care in that nursing home before the commencement of home-delivered nursing services, and meeting the inspection requirements of RCW 18.51.091 shall be considered a certified home health agency as defined in RCW 70.126.040:  PROVIDED, That the patient care standards promulgated pursuant to chapter 18.51 RCW are substantially equivalent to those required for certification pursuant to RCW 70.126.040 strictly for the purposes of RCW 48.21A.090, 48.21.220, and 48.44.320.
