AN ACT Relating to timber tax rates; amending RCW 84.33.041 and 84.33.065; repealing RCW 84.33.042, 84.33.043, 84.33.044, 84.33.045, 84.33.046, 84.33.066, and 84.33.067; providing an effective date; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 2, chapter 204, Laws of 1984 and RCW 84.33.041 are each amended to read as follows:

          (1) An excise tax is imposed on every person engaging in this state in business as a harvester of timber on privately or publicly owned land.  The tax is equal to the stumpage value of timber harvested for sale or for commercial or industrial use multiplied by the rate ((provided in this chapter)) of six and one-half percent.

          (2) A credit is allowed against the tax imposed under this section for any tax paid under RCW 84.33.051.

          (3) Moneys received as payment for the tax imposed under this section and RCW 84.33.051 shall be deposited in the timber tax distribution account hereby established in the state general fund.

 

        Sec. 2.  Section 41, chapter 204, Laws of 1984 and RCW 84.33.065 are each amended to read as follows:

          For timber harvested in 1992 and thereafter, the rate provided in RCW 84.33.055 shall be reduced by six percent.

 

          NEW SECTION.  Sec. 3.  The following acts or parts of acts are each repealed:

                   (1) Section 3, chapter 204, Laws of 1984 and RCW 84.33.042;

          (2) Section 4, chapter 204, Laws of 1984 and RCW 84.33.043;

          (3) Section 5, chapter 204, Laws of 1984 and RCW 84.33.044;

          (4) Section 6, chapter 204, Laws of 1984 and RCW 84.33.045;

          (5) Section 7, chapter 204, Laws of 1984 and RCW 84.33.046;

          (6) Section 42, chapter 204, Laws of 1984 and RCW 84.33.066; and

          (7) Section 43, chapter 204, Laws of 1984 and RCW 84.33.067.

 

          NEW SECTION.  Sec. 4.     This act is necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect July 1, 1985.
