AN ACT Relating to the small business development center; amending RCW 28B.30.530 and 28B.30.533; adding new sections to chapter 28B.30 RCW; and making an appropriation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 1, chapter 77, Laws of 1984 and RCW 28B.30.530 are each amended to read as follows:

          (1) The board of regents of Washington State University shall establish the Washington State University small business development center.

          (2) The center shall provide management and technical assistance including but not limited to training, counseling, and research services to small businesses throughout the state.  The center shall work with other educational institutions and public and private community development and economic assistance agencies and shall work towards the goal of coordinating activities with such agencies to avoid duplication of services.

          (3) The administrator of the center may contract with other public or private entities for the provision of specialized services.

          (4) The small business and development center may accept and disburse federal grants or federal matching funds or other funds or donations from any source when made, granted, or donated to carry out the center's purposes.

 

          NEW SECTION.  Sec. 2.     There is created the small business development center advisory board.  The board shall consist of:

          (1) The dean of the college of business and economics at Washington State University;

          (2) The dean of the school of business and economics at the University of Washington;

          (3) The director of the state system of community colleges;

          (4) The director of the department of community development;

          (5) The director of the department of commerce and economic development;

          (6) The regional advocate of the federal small business administration;

          (7) Four public members appointed by the governor.  The governor shall select the public members based on their direct involvement in the services provided by the small business development center; and

          (8) Four members of the legislature.  Two of the legislative members shall be appointed by the president of the senate and two of the legislative members shall be appointed by the speaker of the house of representatives.  The legislative members appointed from each house shall be from different political parties.

 

          NEW SECTION.  Sec. 3.     The duties of the small business development center advisory board shall be:

          (1) To review and approve the program and budget proposal for the center, including any proposals required to be submitted in order to receive matching funds or other donations;

          (2) To provide policy guidance to the director of the center;

          (3) To insure that the center's activities are coordinated with other state and federal programs that provide services that are related to those provided by the center; and

          (4) To report annually on the first day of each annual legislative session to the legislature and the governor.  The annual report shall include an evaluation of the program's effectiveness during the past year and a program work plan for the current year.

 

          NEW SECTION.  Sec. 4.     The small business development center may utilize the state community college system as one of the public contractors and as one means of providing technical aid to existing and proposed small businesses.  Funds appropriated for this purpose may be used to match federal small business administration grants and for other means of supporting small business assistance centers operated under contract with community college districts of the state.

 

        Sec. 5.  Section 2, chapter 77, Laws of 1984 and RCW 28B.30.533 are each amended to read as follows:

          If any part of RCW 28B.30.530 or sections 2 through 4 of this 1985 act is found to be in conflict with federal requirements which are a prescribed condition to the allocation of federal funds to the state, the conflicting part ((of RCW 28B.30.530)) is hereby declared to be inoperative solely to the extent of the conflict and with respect to the agencies directly affected, and such finding or determination shall not affect the operation of the remainder of RCW 28B.30.530 or sections 2 through 4 of this 1985 act in its application to the agencies concerned.

 

          NEW SECTION.  Sec. 6.     Sections 2 through 4 of this act are each added to chapter 28B.30 RCW.

 

          NEW SECTION.  Sec. 7.     There is appropriated from the general fund to Washington State University for the biennium ending June 30, 1987, the sum of six hundred twenty-six thousand dollars for the purpose of carrying out section 4 of this act.
