AN ACT Relating to adverse possession; and adding a new section to chapter 7.28 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 7.28 RCW to read as follows:

          When any person possesses the surface of any lands, tenements, or hereditaments by actual, open, and notorious possession, the limitation shall not begin to run with respect to any severed subsurface interests unless that person possesses the severed subsurface interests by actual, open, and notorious possession.
