BACKGROUND:

The holder of a liquor license may assign and transfer the license under rules adopted by the Liquor Control Board.  The board, however, has no authority to issue temporary licenses pending the transfer of the license.

SUMMARY:

The Liquor Control Board may issue a temporary retail or wholesale license to a transferee of the license to continue the operation of the premises during the period a transfer application is pending.

To receive a temporary license, the following conditions must be met:  the premises must have been operated under a license within 90 days of the application; the license must be surrendered; and the applicant must have applied for transfer and paid a temporary license fee as established by the board.

The temporary license is for a period up to 60 days, and may be renewed for an additional 60 days.  The refusal to issue or extend a temporary license shall not entitle the applicant to a hearing.  A temporary license may be canceled or suspended summarily by the board for good cause.
