BACKGROUND:

 

Users of off-highway special fuels who hold a special fuel license must report the usage of off-highway fuel used on a yearly basis.

 

Recently, the Department of Licensing gave notice that all licensed special fuel users must report the amount of special fuel used for off-highway uses by date and by specific piece of equipment in which the fuel was used.

 

Because of the number and variety of pieces of equipment and the frequency of refueling that some special fuel users experience, there is some concern that compliance with the new ruling by the Department may be very difficult and costly to achieve.  The ruling requires a daily accounting of special fuel use.

 

In response to this concern, the Department has delayed the implementation of the new ruling to permit requests for relief from this reporting procedure.

 

SUMMARY:

 

Special fuel users who use special fuel off-highway for farming, logging or construction are exempt from:  (1) reporting the number of gallons of special fuel used that is not subject to special fuel tax, (2) maintaining an off-highway versus on-highway use record on a daily basis, and (3) keeping a monthly record of total gallons of special fuel used.

 

Persons exempt from these procedures shall certify the number of gallons used for off-highway use when filing a special fuel user tax report.
