BACKGROUND:

 

Counties are authorized to permit solid waste disposal facilities located in unincorporated areas of the county.  Conditional use permits provide authorization to conduct certain activities if specified conditions are met.  Counties must hold public hearings before issuing conditional use permits.

 

SUMMARY:

 

Incinerators or landfills operating in an unincorporated area of a county, and having an annual capacity of five or more tons, is subject to a conditional use permit issued by the county.  The issuance or denial of such a permit may be appealed to the county legislative authority.
